Argentina approves that non-binary people can be identified in their ID with the option “X”

The Argentine Government has made official this Wednesday the incorporation in the National Identity Documents (DNI) the possibility that people who do not recognize themselves within the female / male binary system can identify themselves in that way with a third option, which will use the letter ” X “. This has been done with the publication of Decree 476/2021 in the Official Gazette, prior to the act of formal announcement of the measure that took place this Wednesday at the Casa Rosada Bicentennial Museum, headed by the president Alberto Fernandez.

The president has assured that “there are a thousand ways to love, be loved and be happy” and has celebrated that “each one finds happiness in their own way”, while highlighting the need to “do everything possible to continue advancing” in the incorporation of rights in Argentina. “Let us advance as much as we can now that we are here,” said the president with enthusiasm, referring to conversations he has with Minister Elizabeth Gómez Alcorta (Women, Gender and Diversity).

“The State should not care about the sex of its citizens”, the president has argued, and has affirmed that the ideal will be reached “when we are all”, while emphasizing that, while looking for “the ideal”, progress is being made in “as possible”, in reference to the change introduced in terms of the definition of gender in the DNI.

Accompanying the president during the ceremony were the Ministers of Women, Gender and Diversity, Elizabeth Gómez Alcorta, and the Minister of the Interior, Eduardo De Pedro.

The decree provided that the National Registry of Persons (Renaper) “must adapt the characteristics and nomenclatures of the DNI and Passports that it issues, exclusively, in order to comply with the provisions of Law No. 26,743”, in reference to the gender identity law approved in Argentina on May 24, 2012.

In this sense, the decree indicates that “a third documentary option will be incorporated in the category ‘sex’ in the DNI and the Passport, in order to contemplate the right to gender identity with respect to those people who are not recognized within the female / male binary system “.

“It is necessary to establish that it can be consigned in the DNI as well as in the Argentine Electronic Passport, in the area reserved for ‘sex’, and according to ICAO Document No. 9303, the nomenclatures” F “,” M “or” X “, leaving thus the scheme of binary possibilities that existed prior to the issuance of this measure, “says the rule.

Who can choose the X

“The nomenclature” X “in the field ‘sex’ will include the following meanings: non-binary, indeterminate, unspecified, undefined, not informed, self-perceived, not consigned; or another meaning with which the person who does not feel understood could be identified in the male / female binomial “, the decree details.

In addition, the DNI that has the letter “X” in the zone reserved for sex “will be valid as a Travel Document for the purposes established in the Agreement on Travel Documents of the Mercosur States Parties and Associated States.”

The decree will also be applicable to those nationals to whom Birth Certificates had been issued within the framework of Law No. 26,743, “prior to the effective date of this measure, without prejudice to what is stated in the birth certificate in the category “sex”.

Likewise, “identical rights” will govern for “foreigners who obtain and / or have the DNI for Foreigners, Exceptional Passport for Foreigners or Travel Document for Stateless or Refugees, under the conditions provided in the relevant regulations”, the publication maintains .

On the other hand, the Renaper must report on the “possibilities of seeing restricted” the “entry, permanence and / or transit situation in those States in which no other categories of sex other than binary ones are recognized.”

Meanwhile, the Ministry of Women, Gender and Diversity is instructed to “issue training for the authorities and personnel of all the agencies that make up the National Public Administration with competence in the matter”, and they must carry out the “normative adjustments, technological and systems “” within a period of 120 days “, indicates the norm.

In the recitals, it is established that the decree is made by virtue of the fact that “the right to gender identity is inherent in the right to one’s own identity, which is part of the field of human rights.”
