The Italian court has decided to release Carles Puigdemont without precautionary measures, as sources of his defense explain to elDiario.es. The Catalan expresident, who was arrested yesterday at the Sardinia airport by the European order issued by the Supreme Court in 2019, will appear tomorrow before the judges, who will have to decide whether to proceed with his extradition process to Spain.
Puigdemont was taken this morning before the judges of the Sassari court of appeal after being arrested yesterday at 9:00 pm at the Sardinian airport. The expresident was on his way to participate in an event organized by the Alghero trustee when he was arrested by the Italian border police.
The first decision that the Italian judges will have to make will be to decide whether the extradition process continues or not. Puigdemont’s defense alleges that the European courts have yet to issue a resolution on his parliamentary immunity and on a preliminary ruling raised by Judge Pablo Llarena himself and that, therefore, we must wait for this matter to be settled.
The magistrate of the Supreme Court does not think the same. This same Friday he has addressed his Italian colleagues to ensure that his arrest warrant is not affected by these processes. “The judicial procedure from which the euro order derives is active and pending the capture of the defendants in rebellion,” he assured today in an official letter. The processing of this question for a preliminary ruling, he affirms, “does not modify the situation in which the procedure is currently, without prejudice to the fact that it must conform in its day to the interpretation of European law, and on the strict questions raised, made by the CJEU” .
