Catalonia asks the Justice for a night curfew in Barcelona and 157 other municipalities

Night curfew is back (if the judges endorse it). After being reluctant to the measure, the Government has requested the Superior Court of Justice of Catalonia (TSJC) to authorize the prohibition of mobility between 1:00 and 6:00 in Barcelona and 157 Catalan municipalities for seven days, where the vast majority of the population lives. They are the populations of more than 5,000 inhabitants that register an incidence of 400 cases per 100,000 inhabitants in the last seven days.

The night curfew, which this Monday was not on the table of the Government, has been imposed before the runaway increase in positives and the endorsement of the Justice to the measure requested by the Valencian Generalitat. The accumulated incidence in Catalonia almost triples that of the Valencian Community. According to Health data, in the last 14 days Catalonia has registered 1,068 cases per 100,000 inhabitants per 384 in the Valencian Community. 20 of the 25 municipalities in Spain with the highest incidence of the virus are Catalan.

As it is a measure that restricts fundamental rights, the curfew in the municipalities will not be able to enter into force until authorized by the TSJC. The judges, after a favorable report from the Prosecutor’s Office, have already endorsed this Wednesday the prohibition of meetings of more than 10 people, the veto to eat and drink outdoors and the order for bars, restaurants and any activity to close at 00: 30 hours.

In an appearance in which he has not accepted questions from the press, the president of the Generalitat, Pere Aragonès, has trusted that the night curfew can come into force this weekend and has defended that it is a measure ” surgical “. “The situation is delicate, extremely fragile”, has warned Aragonès.

The legal services of the Government delivered this Tuesday afternoon to the president of the Generalitat, Pere Aragonès, a report that cleared the request for a night curfew, provided that it was by municipalities and did not affect the community as a whole. Until now, the Catalan Executive was reluctant to contemplate the night curfew since, in its opinion, it was only possible with a state of alarm in force. But the decision of the Valencian Justice and the reproaches of the main Catalan municipalities have forced a change of plan.

The Government has ended up asking for a night curfew after the numerous criticisms of the Catalan mayors and mayors of the restrictions announced this Monday. The municipal representatives spoiled the Government that left them all the responsibility with the recommendation to close beaches and squares at 00:30 hours to stop the bottles and the concentrations of people.

“If what they want is a curfew, ask for it. And if not, let them tell us exactly what can be done in the squares, beaches and in public spaces, “the mayor of Barcelona, Ada Colau, lamented on Tuesday, warning that the council does not have” sufficient “resources to close all the kilometers of beach in the city. Along the same lines, the mayor of Castelldefels, the socialist Maria Miranda, spoke: “Closing five kilometers of beach every day is complicated.”

Mayors of ERC such as the first mayor of Sant Cugat, Mireia Ingla, also asked to recover the curfew, as did the mayor of Badalona, the popular Xavier García Albiol. “Transferring to the mayors, as the Government does, the responsibility of closing beaches and parks after 00:30 a.m. seems to me a huge irresponsibility. I ask the Generalitat for courage and that it decree the curfew, otherwise the measure is literally impossible “Albiol claimed.

The hospital admissions figures were not so bad in Catalonia since last May, still with a state of alarm in force. This Wednesday there are 1,185 people admitted to Catalan hospitals, 127 more than this Monday. There have also been 10 more admissions to ICUs, which now reach 219 patients. The new positives are 8,378.
