The judge accepts accusations in the case of the masks to investigate commissions “with thousands of daily deaths”


The judge investigating the case of the millionaire commissions resulting from contracts for the purchase of sanitary material from the Madrid City Council has accepted the consistory, the PSOE and Podemos as accusations in the instruction, waiting for Más Madrid and its spokesperson Rita Maestre to contribute a formal defect and can be personified as well. The investigation started a few days ago after Court 47 admitted the complaint filed by the Anti-Corruption Prosecutor’s Office. As revealed exclusively by elDiario.es, the Public Ministry has been examining for more than a year the millionaire commissions charged by Luis Medina Abascal and Alberto Luceño in exchange for mediating the arrival of masks, gloves and antibody tests to Madrid from China in the first weeks of the state of alarm. Three contracts signed with a Malaysian company and with huge premiums of which they charged six million in commissions. The person who put them in contact with the City Council was also a cousin of the city’s mayor.

The judge has already decided to charge the two businessmen and call them to testify on April 25 at the same time that their assets are seized. With the money from the commissions, according to the Anticorruption complaint, Medina bought a sailboat that he called “Feria”, after his family dukedom, and Luceño bought, among other things, 12 cars and 3 luxury watches and a house in one of the most exclusive areas of the Community of Madrid. The objective, suspects the Prosecutor’s Office, was to launder the loot after it arrived directly from Malaysia to their bank accounts in Madrid.

The case, in addition to the public accusation promoted by the Prosecutor’s Office, will feature several popular accusations: the PSOE and its municipal group in the consistory and Podemos. For the moment, the magistrate has rejected the same request from Más Madrid and his spokesperson, Rita Maestre, for not having correctly provided the general power of attorney for lawsuits. The same magistrate offered shares to the Madrid City Council itself and in this order he also accepts the administration led by José Luis Martínez-Almeida as a private prosecution.

The instructor justifies the inclusion of these accusations in the type of facts that are investigated. “The crimes investigated not only affect public funds, but also have a general interest and enormous public repercussion,” explains the judge. In fact, he adds, the management of money from the municipal coffers is being investigated “in a matter as serious as the acquisition of medical supplies at the height of the COVID-19 pandemic, with thousands of deaths daily, and to determine whether Those funds benefited certain private individuals to the detriment of the generality of citizens.”

The three contracts awarded to the Malaysian company Leno were signed in the last days of March 2020 and were managed through the municipal funeral services company. This allowed that it could be done through the emergency process and that the controls and publicity were much lower than an open procedure with public competition. According to the Prosecutor’s Office, in this context Luis Medina Abascal – son of the deceased Duke of Feria – contacted the council through a cousin of the mayor.

The complaint explains that the commissions of both businessmen came from an increase in the price of the product that, on occasions, exceeded 400%. The Court of Auditors has already examined these contracts, although without being aware of the existence of commissions, but in that report it already pointed out that the contracts of this company were the most expensive of all the Spanish municipalities in terms of FFP2 masks and antibody tests .
