The PP recovers the demand to modify the law to unblock the Judicial Power three years later

The PP of Alberto Núñez Feijóo recovers the demands of Pablo Casado to lift the blockade they have maintained on the renewal of the General Council of the Judiciary for more than three years and to which the Constitutional Court has recently added. The party’s Steering Committee has launched today a proposal that raises the main red line that the party has already set in the past: linking the negotiation of the CGPJ, whose current mandate expired in 2018, to a complete reform of the Law of the Judiciary. And postpone it all half a year more. “The situation has reached such a degree of deterioration that it is not enough to renew the institutions”, pointed out the Institutional Secretary of the PP, Esteban González Pons, who has pointed out to the Minister of the Presidency, Félix Bolaños, for allegedly leaking messages regarding this negotiation exchanged between both.

“We demand the withdrawal before Thursday of the law to appoint the Constitutional Court that the Government has agreed with ERC,” said Pons, referring to the rule that will be processed this week by the urgent route in Congress and that will allow to the governing body of the judges to appoint the two magistrates of the court of guarantees that correspond to it, without lifting the current prohibition to appoint magistrates of the Supreme Court. This unblocking would in turn allow the Government to appoint the two magistrates who report directly to it.

The law, stated ad hoc for the Constitutional, has been harshly criticized by the PP since its approval. But until now they had not raised their withdrawal as a condition sine qua non to agree to renew the CGPJ, whose members will rule this afternoon on their situation. Its president, Carlos Lesmes, has already demanded before Feijóo that the parties reach an agreement since some jurisdictional bodies appear to collapse due to the lack of relief of retired judges.

The PP thus requires, as Casado did, preconditions to fulfill the constitutional mandate: the withdrawal of the bill and the commitment to remodel the formula for appointing members, in force since the 80s of the last century and that no one until now has changed substantially. If this happens, Pons said, the PP is “willing to negotiate the renewal of the CGPJ, the Supreme Court and the Constitutional Court.” “Simultaneously”, he added, “we ask for reform of the Organic Law of the Judiciary to guarantee a regeneration of the CGPJ’s election model”.

Feijóo’s management has reflected its proposal in a document that it has sent to the Government minutes before announcing it at a press conference. The PP assumes that the current law is the only one with which the CGPJ can be renewed, it has no other choice, but it demands in its proposal that it be done with future criteria, which would prolong the current situation of the Judiciary for another six months.

The document: “A proposal to reform the new CGPJ will be commissioned and a paper will be created in the Congress of Deputies, within the Justice Commission, which will issue a report on the matter, both within a non-extendable period of six months” . Thus, the PP delegates part of the legislative capacity of the Cortes Generales to the body chaired by Carlos Lesmes.

Government contacts

González Pons has also revealed that this same Sunday he has maintained “contacts” by mobile message with his interlocutor, the Minister of the Presidency, Félix Bolaños. That yes, he has not wanted to reveal the content, and has pointed out to him for supposedly filtering The world the WhatsApp that both were sent in the weeks prior to the Andalusian elections, when the PP said it wanted to negotiate the CGPJ with the Government.

Then, the Andalusian call paralyzed the intentions of the PP, which, however, assured in public that it was maintaining negotiations with Bolaños. The world however, he revealed that when Pons spoke of contacts with the Executive, in reality what was produced were silences or long before the specific requests of the minister.

Pons said this Monday, at the same time, that there was never a negotiation with the Government because it would be very “cynical” after they had been called “mugs”. He has also given truth to the messages he posted The world saying that “it did not help” the negotiation “that WhatsApp that I sent were leaked to some media outlet.”

To questions from journalists, Pons has assured that he has never “lost the thread” of contact with the Government. He has even pointed out that in recent days there have been exchanges of messages. The last ones, this same Sunday. In the opinion of the PP, the content of these conversations, which they have not revealed, leads them to think that the PSOE will withdraw the bill.

But from the Government they point in the opposite direction. The spokeswoman, Isabel Rodríguez, pointed out this Monday at the press conference after the Council of Ministers that “compliance” with the constitutional mandate “is not negotiable”. “The only thing that the Government asks of the PP is that it complies with the Constitution, which is what the rest of us Spaniards do wherever we are”, she pointed out, to settle: “Before starting to speak, what we have to do is comply” .
