The Supreme confirms the conviction of the doctor Jesús Candel ‘Spiriman’ for insulting Susana Díaz


The Supreme Court has confirmed a fine of 6,480 euros for Jesús Candel, an Andalusian doctor known as ‘Spiriman’, for insulting Susana Díaz and the former Andalusian Deputy Minister of Health, Martín Blanco, in videos and publications on various social networks. The judges reject the doctor’s appeal and confirm his conviction for two continued crimes of libel with publicity.

Jesús Candel, a doctor from Granada who gained notoriety by leading the protests against the health management of the Junta de Andalucía during the government of Susana Díaz, developed for years an intense activity in various profiles on social networks in which, among other things, He protested about the state of Andalusian health but also dedicated insults or expletives to various public figures.

In this case, the Supreme Court understands that the insults he uttered against the then president of the Andalusian Government are not protected by freedom of expression. “Son of a bitch, scoundrel, bastard, ass licker” were some of the expressions she used along with phrases like “you’re going to bleed up your ass, bastard” or “it makes me want to shit on your face”.

That, says the criminal court, is not protected by their right to freedom of expression and to criticize the health management of the autonomous community. “None of these epithets, in the context in which they were pronounced, can be considered protected by the constitutional text,” says the Supreme Court. “Our system of freedoms does not grant protection to expressions such as those used by the accused in the context in which they were used.”
