The Supreme Court refuses to urgently annul the appointment of the interim president of the Council of the Judicial Power


The Supreme Court has rejected the request for very precautionary measures presented by a member of the General Council of the Judiciary, Wenceslao Olea, against the appointment of the progressive Rafael Mozo as a substitute for Carlos Lesmes in the presidency of the body. Carlos Lesmes resigned as president of the governing body of the judges on October 10, announcing his return to the contentious-administrative chamber of the Supreme Court. A few hours earlier, the magistrate, after stating that he had “lost all hope” in the possibility of an agreement and that he did not want to be “an accomplice in a situation that I abhor and that is unacceptable” after more than three and a half years with the expired mandate .

One of the doubts that arose at that time was who would replace Lesmes both at the head of the CGPJ and at the head of the Supreme Court. A report from the technical office suggested that it should be Judge Francisco Marín Castán, president of the Supreme Court’s civil chamber, but finally the plenary session opted for the progressive Rafael Mozo, the oldest member.

Wenceslao Olea, magistrate of the Supreme Court and member, appealed and proposed some very precautionary measures that are now rejected by the contentious-administrative chamber to which it belongs. Now the same room opens a process of precautionary measures in which all the parties involved will be able to make their allegations before receiving a new decision from the magistrates.
